Truck Accidents Attorneys

Tractor Trailer (Trucking) Accidents are on the Rise

Every year, trucking accidents take the lives or seriously injure tens of thousands of people. In fact, according to the United States Department of Transportation, there are approximately 500,000 trucking accidents every year in the United States, and of these accidents, approximately 5,000 result in someone’s death. What’s more, the Department of Transportation estimates that one (1) of every eight (8) motor vehicle accident deaths involves a truck. Approximately sixty-eight percent (68%) of all fatal trucking accidents happened in rural areas, and approximately sixty-six percent (66%) of all fatal trucking accidents occurred during daytime hours. These are very alarming statistics, and they’re on the rise.

Trucking is big business; revenues total in the hundreds of billions of dollars every year, and estimates indicate that trucking revenues will be in the trillions of dollars by 2015. This, of course, means more and more trucks with which we’ll have to share the road. And with more and more trucks on the road, more and more accidents are sure to follow.

Trucking Accidents Involve Very Complicated Claims Against Multiple Defendants

Did you know that tractors are generally owned by one person or corporation while the trailer is owned by another? Did you know that tractors are often registered in one state while the trailer is registered in another? Did you know that many truck drivers are independent or sub contractors required to have their own insurance? Did you know that trailer owners often lease the trailer to the shipper, making the shipper responsible for loading and unloading the freight? This is all of critical importance as it has a direct effect on who is responsible for injuries suffered in a trucking accident as well as the applicable statute(s) of limitation and court(s) within which suit must be filed.

Those Injured in a Trucking Accident May Have Multiple Claims

Those injured in trucking accidents have a myriad of potential claims, including workers’ compensation claims as wells as claims against the driver that caused the accident, the state, city, or township in which the accident happened, the designer, manufacturer, distributor, and owner of the tractor or trailer, those responsible for loading the freight, and so many others. Additionally, those injured in trucking accidents may also have claims against his/her own insurance company for medical payments, income loss benefits, uninsured or underinsured motorist benefits, funeral expenses, and much more.
