$1.1 Million (Verdict) - Motorcycle Accident in Montgomery County, PA
$1,100,000 verdict for an unlicensed, drunk motorcyclist who suffered a brain injury when he was cut off by a car exiting a parking lot, forcing him to dump his motorcycle and strike his head on the pavement. My client was not wearing a helmet as required by law, and he was more than double the legal intoxication limit in Pennsylvania. We were able to preclude this damning information from being admitted into evidence, which ultimately helped win the case. Believing my client’s drunkenness caused the accident, and believing his failure to wear a helmet caused his injuries, the defense chose not to make any pre-verdict settlement offers. $981,000 (Verdict) - Fall on Residential Driveway in Berks County, PA
$981,000 verdict for a FedEx delivery driver who injured his lower back when he stepped in a tire rut of a residential driveway while making a delivery during an active snow storm in Sinking Springs, PA. This was particularly difficult case in which liability and injuries were hotly contested, because of which the Defendant homeowners’ insurance carrier didn’t make any settlement offers at all. The defense relied heavily on the opinions of a very prominent and well respected engineer who inspected the driveway several times and opined that it was in good condition and wasn’t dangerous when the fall happened. That expert changed his mind during Attorney Gibbons’s grueling cross examination, however, and reluctantly agreed the driveway did, in fact, have some dangerous spots, one of which being in the precise location where our client fell. $800,000 (Verdict) - Fall on Sidewalk in Luzerne County, PA
$800,000 verdict for a 70-year old woman who slipped and fell on a snow-covered sidewalk at her grandson’s daycare in Hazleton, PA. This was a particularly difficult case as the sidewalk had actually been shoveled by the daycare before our client slipped and fell. We were able to convince the jury that the manner in which the daycare shoveled the snow was improper, and that it was because the daycare improperly shoveled that our client slipped and fell. Believing our client was at fault, and that her injuries “were degenerative (i.e., not caused by the accident), the defense chose not to make any pre-verdict settlement offers. $500,000 (Settlement) - Fall at Apartment Complex in York County, PA
$500,000.00 settlement for a man who broke his ankle when he fell from the second floor balcony of his rented apartment. My client had lived in the apartment for nearly 2 years, during which time the balcony was in such disrepair that he used it only once. The defense initially denied the claim, arguing my client “assumed the risk” of falling when he walked out onto the balcony knowing it was inherently dangerous. $490,000 (Settlement) - Police Brutality in Philadelphia County, PA
$490,000.00 settlement for a drunk Irishman who broke his neck while in police custody. My client had been arrested for simple assault after punching a bartender and an off-duty police officer, then spitting at uniformed police summoned to the scene. While being transported to the precinct for processing, he alleged to have been taken on a “nickel ride” — a wild ride intended to injure him — which resulted in his broken neck. The police, however, argued he was a belligerent drunk who broke his own neck by violently banging his head against the holding cell bars. This case settled for $490,000 of the $500,000 maximum allowed under law just moments before our medical expert was to take the witness stand.
