Got Hurt? Get Gibbons!

Because we hate losing more than we love winning!

Proof is in the Pudding - Our Knowledge and Dedication Get Things Done

Most law firms brag about their biggest recoveries, but these big recoveries don’t tell you the true nature of the case or the legal skill required to lock down the win. If someone is killed in a car accident clearly caused by the defendant, who has a million dollars in available insurance coverage, does the case require a lot of legal skill and know-how? Does it require an aggressive, hard-nosed litigator?

Rather than brag about our biggest recoveries, we feel it more important to brag about some of our most difficult victories; victories that required legal skill and know-how coupled with aggressive, hard-nosed representation. After all, you don’t want to know how well we handled the easy cases. You want to know how well we handled the difficult cases.

$1.1 Million (Verdict) - Motorcycle Accident in Montgomery County, PA

$1,100,000 verdict for an unlicensed, drunk motorcyclist who suffered a brain injury when he was cut off by a car exiting a parking lot, forcing him to dump his motorcycle and strike his head on the pavement. My client was not wearing a helmet as required by law, and he was more than double the legal intoxication limit in Pennsylvania. We were able to preclude this damning information from being admitted into evidence, which ultimately helped win the case. Believing my client’s drunkenness caused the accident, and believing his failure to wear a helmet caused his injuries, the defense chose not to make any pre-verdict settlement offers. This verdict was a featured story in The Legal Intelligencer, Pennsylvania Law Weekly, and Verdict Search: Pennsylvania.

$981,000 (Verdict) - Fall on Residential Driveway in Berks County, PA

$981,000 verdict for a FedEx delivery driver who injured his lower back when he stepped in a tire rut of a residential driveway while making a delivery during an active snow storm in Sinking Springs, PA. This was particularly difficult case in which liability and injuries were hotly contested, because of which the Defendant homeowners’ insurance carrier didn’t make any settlement offers at all. The defense relied heavily on the opinions of a very prominent and well respected engineer who inspected the driveway several times and opined that it was in good condition and wasn’t dangerous when the fall happened. That expert changed his mind during Attorney Gibbons’s grueling cross examination, however, and reluctantly agreed the driveway did, in fact, have some dangerous spots, one of which being in the precise location where our client fell. This verdict was a featured story in The Legal Intelligencer, Pennsylvania Law Weekly, and Verdict Search: Pennsylvania.

$800,000 (Verdict) - Fall on Sidewalk in Luzerne County, PA

$800,000 verdict for a 70-year old woman who slipped and fell on a snow-covered sidewalk at her grandson’s daycare in Hazleton, PA.  This was a particularly difficult case as the sidewalk had actually been shoveled by the daycare before our client slipped and fell.  We were able to convince the jury that the manner in which the daycare shoveled the snow was improper, and that it was because the daycare improperly shoveled that our client slipped and fell.  Believing our client was at fault, and that her injuries “were degenerative (i.e., not caused by the accident), the defense chose not to make any pre-verdict settlement offers. This verdict was a featured story in The Legal Intelligencer, Pennsylvania Law Weekly, and Verdict Search: Pennsylvania.

$500,000 (Settlement) - Fall at Apartment Complex in York County, PA

$500,000.00 settlement for a man who broke his ankle when he fell from the second floor balcony of his rented apartment. My client had lived in the apartment for nearly 2 years, during which time the balcony was in such disrepair that he used it only once. The defense initially denied the claim, arguing my client “assumed the risk” of falling when he walked out onto the balcony knowing it was inherently dangerous. This settlement was a featured story in Pennsylvania Law Weekly and Verdict Search: Pennsylvania.

$490,000 (Settlement) - Police Brutality in Philadelphia County, PA

$490,000.00 settlement for a drunk Irishman who broke his neck while in police custody. My client had been arrested for simple assault after punching a bartender and an off-duty police officer, then spitting at uniformed police summoned to the scene. While being transported to the precinct for processing, he alleged to have been taken on a “nickel ride” — a wild ride intended to injure him — which resulted in his broken neck. The police, however, argued he was a belligerent drunk who broke his own neck by violently banging his head against the holding cell bars. This case settled for $490,000 of the $500,000 maximum allowed under law just moments before our medical expert was to take the witness stand.  This settlement was a featured story in The Legal Intelligencer, Pennsylvania Law Weekly, Verdict Search: Pennsylvania, The Philadelphia Inquirer, and on 6 ABC Actions News and Fox 29 News: Special Investigation with Jeff Cole.

Side Note:  My client had previously been represented by another attorney for the same incident, and he LOST in Federal court.

$325,000 (Settlement) - Car Accident in Schuylkill County, PA

$325,000.00 settlement for a 64-year old man who suffered a concussion in a car accident in Pottsville, PA.  This settlement was a featured story in Pennsylvania Law Weekly and Verdict Search: Pennsylvania.

$313,000 (Verdict) - Fall at Apartment Complex in Philadelphia County, PA

$313,000.00 verdict for a man who broke his ankle after falling down a flight of stairs at his rented apartment. My client was rolling a motorcycle down the stairs, which broke beneath his feet, causing him to fall. This verdict was a featured story in Pennsylvania Law Weekly and Verdict Search: Pennsylvania.

$250,000 (Verdict) - Car Accident in Camden County, NJ

$250,000.00 verdict for a 60-year old man who aggravated his pre-existing neck and back injuries when he was rear ended by an SUV. Because my client had been treating for neck and back problems for years prior to the accident, the defense argued my client’s injuries weren’t caused by the accident, because of which it didn’t make any pre-verdict settlement offers. This verdict was a featured story in New Jersey Law Journal and Verdict Search: New Jersey.

$250,000 (Settlement) - Car Accident in Montgomery County, PA

$250,000.00 settlement for a 58-year old man who aggravated a pre-existing shoulder injury when he was rear-ended by a sanitation truck in Norristown, PA. Prior to the accident, my client had been treating for a torn rotator cuff and torn biceps muscle for nearly a year. This settlement was a featured story in Pennsylvania Law Weekly and Verdict Search: Pennsylvania.

$240,000 (Settlement) - SEPTA Bus Accident in Philadelphia County, PA

$240,000.00 settlement for a man who broke his elbow when fell while walking to his seat on a SEPTA bus as it was pulling off from a stop. The defense initially argued my client “assumed the risk” of injury, and was therefore responsible for his injuries, by choosing to walk past 19 empty seats before he fell. This settlement was a featured story in Pennsylvania Law Weekly and Verdict Search: Pennsylvania, and on Fox 29 News: Special Investigation with Jeff Cole.
